Whitneyville Armory Kennedy .44-40 WCF 24 inch Lever Action Rifle
While today he is better known by most as the inventor of the cotton gin, Eli Whitney was also a
singularly accomplished firearms designer who perhaps had greater personal success with firearms
than with his most well-known invention
He supplied arms to the United States military from the time of the Whiskey
Rebellion past the end of the Civil War. He also sold arms commercially where he also found success
with firearms like this Whitney lever rifle which started as an evolution of the action designed by
Andrew Burgess.
With the more traditional style of lever used here, that would date this one being MANUFACTURED
between 1884-1886.
It comes with a 22-inch octagon barrel chambered in .44-40 WCF. Just like the Winchester 1873,
this rifle would have been a great companion to a Colt or Merwin Hulbert revolver in the same caliber.
This a Rare opportunity to add this very distinct example of our lever gun history.

Sights / Optics: The front sight is a blade dovetailed to the barrel above the muzzle. The rear sight is
a square notch buckhorn elevator sight dovetailed to the top rear of the barrel.
Stock Configuration & Condition: The stocks are two-piece walnut featuring a nose cap, a straight
grip, a straight comb and a contoured metal with a sliding brass door to a buttstock storage
compartment.
The wood shows light to moderate nicks, scratches, compressions and some minor handling and
storage marks.
The LOP measures 12 1/2 inch from the front of the trigger to the back of the buttplate. The stocks
are in Very Good overall condition as ANTIQUE

When shipping is required for any purchase an additional charge will occur the day the item has been shipped. We ship mainly at cost via Canada Post. We aim to have items out the door within 15 business days after auction close.
Please note that due to restrictions we will ship all Ammunition by courier Canada wide - No ammo can be shipped outside of Canada.. We will use whatever coourier serves your location and is the least expensive....
We are NOT responsible for damage during shipping. We don't guarantee delivery times and will not refund shipping charges for parcels that are not delivered by a specific date.
Items over $200 will be insured and a signature 18+ is required (unless under $200 or going by letter mail).
NO REFUNDS WILL BE GIVEN ON LOTS THAT WE ARE UNABLE TO SHIP TO YOU.
Shipping charges will be determined after preparation as we need to pack, weigh and measure each box. Your credit card will be charged this amount before the parcel leaves.

TERMS OF PAYMENT: At the conclusion of the Auction all items purchased will be charged to the Credit Card that was provided at registration to guarantee payment. If shipping is required for any purchase an additional charge will occur the day the item has been shipped. A $40.00 late payer fee may be added to any invoice that can't be processed at the conclusion of the sale. Please ensure that you have provided us with the correct number and expiry date. Recurring problem payers will be banned from future sales. Bidders are responsible for full payment of all their purchases at the drop of the hammer. Our Consignors are paid based on the hammer price. We will attempt to charge your credit card partial amounts until the amount is paid in full. Any purchase which has not been fully paid may be forfieted. There will be no refund of partial payments. KOS Auctions do not guarantee or make warranties on any lot. We acknowledge that errors may occur, however we endeavour to give you accurate information in descriptions provided. We are available by email (pocomilitary@gmail.com ) and phone (604-796-0006 ) to answer questions and provide additional photographs prior to bidding, if required. No employee of KOS Auctions is authorized to make any representation or warranty, oral or written, with respect to any lot or item for sale other than the CEO. KOS Auctions will not return or refund money if an item is not exactly in the same condition as listed in online listing. Firearm rateings in the online listing are subjective and are of visual opinion, no mechanical inspection or test firing is undertaken by KOS. Any concern must be addressed with a recognized gunsmith prior to firing any firearm.
CANADIAN BIDDERS: Firearms, Magazuines and Ammunition purchasers require a valid P.A.L. (Possession and Acquisition License). All restricted and prohibited firearms are registered with the Canadian Firearms Program and will be transferred to the purchaser following the completion of the sale and receipt of full payment provided the purchaser has the correct licensing documents.. It is the purchaser’s responsibility to determine that they have the correct category of license for the intended purchase prior to bidding. You will require a P.A.L. for all Prohibited/Restricted/Non-Restricted category firearms. No P.A.L. is required for Antique category firearms.
Ammunition and Firearms must be shipped to an address on file with the CFO. Ammunition and Firearms cannot be shipped in the same box.
Ammunition will now be shipped exclusively with UPS. We must ship Ammunition to your address on file with the CFO. Please ensure that you have a UPS delivery agent in your area prior to bidding, as UPS does not cover all rural areas. We do not ship ammunition to the USA.
Any items that are purchased that we are not able to deliver/ or you don’t have a valid license to possess will be sold at the next opportunity, any money paid by buyer will be forfieted..
As we are selling Firearms and Ammunition it is imperative that bidders/customers provide us their correct information. We require your full correct name as shown on your PAL, PAL number, date of birth, the mailing address that is associated with your PAL.
U.S.A./INTERNATIONAL BIDDERS:
Please be advised that we cannot ship any sort of firearm directly to USA or International buyers. Buyers must use a third-party exporter for these items.
We cannot ship receivers, ammunition, primers, magazines, primed brass, air guns or grenades to USA or International buyers. These cannot be shipped by us or an exporter. Do not bid on these items.

You have sole responsibility for your purchases. You and or your importing FFL will be required to file paperwork with BATF in order to be able to import an item. Please check with your FFL and/or BATF regarding import of specific items. Not all firearms are able to be imported/exported into the USA. Note that any items that have been purchased but are deemed not importable/exportable will be forfited and no refunds will be given.
You have sole responsibility for your purchases. Please check with your governing body and Borderview to ensure your intended purchase is importable, as well as the third party exporter to ensure they will be able to export to your country, this should be done prior to bidding. Not all firearms are able to be imported/exported Internationally.
If you are unable to complete the transaction within 6 months, the lots will be sold at the next auction. Any monies paid will be forieted.
ALL BIDDERS:
BUYERS PREMIUM & TAXES: All items purchased online are subject to a 14% buyers premium. Canadian Taxes will be charged at the rate applicable to the shipping destination. Item(s) purchased and shipped outside of Canada are not subject to Canadian taxes, however you will be responsible for customs or duty charges.

STORAGE FEES: of $5.00 per item per day may be added to items that are left past the dates in the pick up section. all items stated as Pick Up must be collected within 5 days of the auction close.
BIDDING: The highest bidder shall be the purchaser and the decision of the auctioneer relating to all matters is final. Pre-bids are time stamped and the earliest bid will win any tie situation. All sales are final and not subject to conditions. All merchandise is sold 'As Is' without recourse to the vendor. All goods advertised or displayed are subject to withdrawal prior to sale within the discretion of the auctioneer. The Auctioneers may reject a bid at their discretion without reason or explanation. Bid increments are fixed for online only auctions. Bid increments are fixed for the pre-bidding and maximum bid portion of Online auctions.

KOS Auctions nor the Consignor makes any representation or warranty, express or implied, as to the title, merchant ability, fitness or condition of the property or as to the correctness of description, genuineness, attribution, provenance or period of the property or as to whether the purchaser acquires any copyrights or other intellectual property rights in lots sold or as to whether a work of art is subject to the artist's moral rights or other residual rights of the artist. All Firearms and Ammunition are sold as Collector lots only. Fitness to fire or otherwise discharge the Firearm or Ammunition is expressly denied by KOS Auctions. A competent Gunsmith should be consulted before attempting to use or fire any Firearm or Ammunition. The Purchaser expressly acknowledges and agrees that in no event shall KOS Auctions or its associated companies be liable for any damages including without limitation any compensatory, incidental or consequential damages.
The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. If we sell firearms that have been previously de-activated by others, these may not meet current or exportable standards. Firearms de-activated by others may or may not have a de-activation letter available. We are not able to search for letters for firearms de-activated by others.
